Many people do not realize the danger that they are putting themselves and others in when they are driving under the influence (DUI). Whether it is under the influence of alcohol, drugs or both does not matter. It remains a serious offence in many states and in Arizona DUI is just as serious as offence in any of the other states. There are a few things to keep in mind when being pulled over and you suspect you may be over the legal limit. However, it is always best to not even drink and drive in the first place as prevention remains the perfect cure no matter what the situation.

According to Arizona DUI legislation, the legal limit is 0.08%. If the level is anywhere between 0.08% and 0.14%, a person will be charged with DUI. When pulled over by a police officer after leaving a party or event remember these few simple tips to survive the ordeal with as much dignity as possible. If you are pulled over remain seated in the car and keep your seatbelt on. Only leave the car if the officer asks you to do so. The officer is going to ask for your driver’s license and registration. Make sure you retrieve it quickly as fumbling around for it might indicate to the officer that you are drunk and it will go into the report.

The only tests that you are bound by law to perform are blood, urine or breath tests for alcohol level. An officer cannot force you to perform any of the other field tests such as walking on a straight line or some other type of test. If asked, politely refuse to perform the test and do not be frightened if the officer threatens to take you to jail. There is no law that forces you to perform field tests. Also politely refuse the request that the officer search your vehicle. Unless the officer is in possession of a search warrant, there is no reason why the officer should be allowed to search your car. The laws are there to protect you in Arizona, in DUI instances and others. Remember your rights.

Speaking of rights, remember that Arizona DUI legislation like all other legislation allows you to refuse questioning without having an attorney present. Simply telling the officer that you cannot and will not answer without the advice of your attorney effectively stops any questioning at the scene. While keeping your rights in mind always remember to cooperate with the officer. Cooperation does not mean you have to comply with all the officer’s requests. It simply means being polite and amiable.

The Arizona DUI legislation is there to protect people from careless drivers. It is also there to protect conscientious drivers. Even if convicted of DUI offence your attitude, disposition and approach to the matter may make things easier for you. The officer is just doing the job that is expected and the officer is not out to get you. By cooperating and remembering your rights you can make things a lot easier for everyone.
